2. Nature of the service

Shopping Elegia provides the technological infrastructure required to operate a shared digital shopping environment.

Each participating store operates independently, in its own name and under its own commercial responsibility.

Shopping Elegia is not the seller of products offered by participating stores, does not issue sales invoices to consumers for those products and does not receive payments for commercial transactions between buyers and merchants.

The platform does not arrange shipping or fulfil orders, without prejudice to any legal obligations directly applicable to its activities.

3. Acceptance of terms

Use of Shopping Elegia requires compliance with these Terms of Use and applicable legislation.

Users must use the platform lawfully and responsibly, respecting the rights of other users and merchants.

Services provided by individual stores may also be subject to the specific commercial terms of the respective seller.

4. User accounts

Certain features may require users to register an account.

Users agree to provide accurate and up-to-date information and to protect their login credentials.

Users should report any suspected unauthorised access to their accounts.

Shopping Elegia may restrict accounts used fraudulently or in breach of these terms, subject to applicable legal procedures and user rights.

5. Products and commercial information

Products, descriptions, images, prices, availability and other commercial information are provided by the merchants responsible for their respective stores.

Each merchant is responsible for the accuracy of the information published and compliance with legal obligations relating to the products offered.

Shopping Elegia may take action regarding content or offers that violate applicable laws or platform rules, in accordance with legal requirements.

6. Orders and payments

Purchases made through Shopping Elegia establish a commercial relationship between the buyer and the store identified as the seller.

Each store is responsible for processing its orders, receiving payments through its available payment methods, issuing invoices and fulfilling its commercial obligations.

Payment conditions, final prices, taxes and any delivery charges must be presented to consumers before purchase confirmation.

When a shopping cart contains products from different stores, separate conditions, payments and deliveries may apply.

7. Shipping, returns and warranties

Shipping, delivery, returns, exchanges, warranties and refunds are the responsibility of the selling store.

Consumers should contact the seller directly to resolve matters relating to their orders.

All applicable statutory consumer rights remain fully protected.

8. Independent stores

Participating stores are independent commercial entities responsible for their business activities, products, services and relationships with customers.

Participation in Shopping Elegia does not establish a partnership, commercial agency or employment relationship between merchants and the platform operator.

Store participation and use of digital commercial spaces are governed by the relevant contractual conditions.

9. Appropriate use of the platform

Shopping Elegia may not be used for fraudulent or unlawful activities or activities that compromise the security and operation of the service.

Attempts to gain unauthorised access to accounts, systems, data or features reserved for other users are prohibited.

Users must respect intellectual property rights and the rights of third parties.

10. Content and intellectual property

The visual identity, graphics, institutional content and proprietary components of Shopping Elegia are protected by applicable intellectual property laws.

Trademarks, images, descriptions and other content published by stores belong to their respective owners or are used under the responsibility of the merchants.

Use of the platform does not grant rights to reproduce or commercially exploit protected content without the necessary authorisation.

11. Availability and operation

Shopping Elegia aims to maintain the availability and proper operation of its platform.

Temporary interruptions may occur due to maintenance, updates, technical failures or external circumstances.

The platform may introduce technical improvements and modifications necessary for security and service development, while respecting applicable contractual and legal obligations.

12. Responsibilities

Merchants are responsible for obligations arising from their sales, including product conformity, invoicing, deliveries, warranties and refunds.

Shopping Elegia is responsible for the services it provides directly and for compliance with its own legal obligations as a digital platform.

Nothing in these Terms of Use excludes or limits liability that cannot legally be excluded or restricted.

13. Reporting illegal content

Users may report content or products they believe to be illegal by providing the identification of the offer, its web address and a reasoned description of the issue.

Reports may be sent to comercial@elegia.studio, without prejudice to any specific reporting mechanisms the platform is legally required to provide.

Reports will be reviewed in accordance with applicable legislation and procedures.

14. Privacy and personal data

Personal data is processed in accordance with applicable legislation and the Shopping Elegia Privacy Policy.

Each merchant is responsible for personal data processing carried out independently as part of its commercial activities.

16. Applicable law

These Terms of Use are interpreted in accordance with the laws applicable to the platform operator and the mandatory provisions of European Union law.
